Notice on Resolution Decisions of Rule Violation

Concerning parties:

Xu Shuai, born in Boxing, Shandong, 1986.

Li Wei, born in Linyi, Shandong,  1988.

Yu Deshui, born in Linshu, Shandong, 1986.

From March 5, 2020 to July 3, 2020, Xu Shuai borrowed and manipulated Li Wei’s account through Yu Deshui, and traded with a certain company on multiple contracts of crude oil futures at Shanghai International Energy Exchange (INE) for illegal profits.

The above-mentioned behavior has violated the provision in Article 29, paragraph 1, section 3 of the Enforcement Rules of the Shanghai International Energy Exchange, which stipulates the conduct of "applying methods such as transferring or splitting positions between accounts, or accommodation trade, to affect the prices on the Exchange, or to transfer funds between accounts or make illegal profits” as constituting rule violation relating to trading management.

Accordingly, INE makes the following decisions:

1. Give Xu Shuai a public censure, and give Yu Deshui and Li Wei a reprimand.

2. Order to make corrections, and suspend the position opening of Xu Shuai, Yu Deshui, and Li Wei for 2 months from the day after receiving the decision on rule violations. 

Relevant futures companies should strengthen the client compliance education, as well as the monitoring and management of online trading, and prevent the recurrence of similar incidents. The resolution decisions of rule violation will be recorded in the Securities and Futures Market Credibility File Database.

 

Note: The Enforcement Rules of the Shanghai International Energy Exchange quoted in this Notice refers to the rules that came into force on August 2, 2019.
