Circular on Enhancing Information Filing for Certain Clients Engaged in Program Trading

To All Members, Overseas Special Participants, and Overseas Intermediaries,

To strengthen the filing of program trading information, pursuant to Article 17 of the Trading Rules of the Shanghai International Energy Exchange, Shanghai International Energy Exchange (INE) will enhance the information filing requirements for certain clients engaged in program trading, effective from July 23, 2021.

1. Filing Standards

INE will draw up a list of clients who need to submit additional information about their program trading activities based on their trading history including order submissions, cancellations, and executions.

For any client that maintains trading codes with multiple members, INE will calculate the number of submitted, canceled, and executed orders on an aggregated basis.

2. Requirements

For a client that has reached the filing threshold, INE will notify its carrying member, who should promptly ask the client to provide the required information. The client should then submit the information to INE through the member, to fulfill its information reporting obligation and enhance the compliance of its trading activities.

Information to be filed includes information about the client, software, trading strategy, and risk control measures. INE may require a client to provide additional information based on its trading behaviors and information on file.

A member should fill out and upload the Program Trading Client Information Form via the Member Service System within ten (10) trading days of receiving the notice from INE. The client should submit to its carrying member a signed or sealed hard copy of the Form for record.

INE will review the information submitted by the member. In case of incomplete or doubtful information, it will notify the member and require the client to submit additional materials or explanations. Upon receiving this notice, the member should make revisions or supplements in a timely manner and as required and then re-file the information.

The circular and Shanghai International Energy Exchange Notice on Filing of Program Trading (INE Circular [2018] No. 4) will be implemented simultaneously.

All members are hereby requested to take this filing seriously. INE may impose self-regulatory measures on members that fail to perform their duties and on clients that refuse to provide the information, fail to provide information as required, or provide false information.
